The terms of using Luciana

These Terms of Service (“Terms”) govern your use of shop-luciana.co and any purchases made through it. By using the site or placing an order, you agree to these Terms.

1. Eligibility

You must be at least 18 years old (or the age of majority in your jurisdiction) to create an account or place an order. By using the site you confirm you meet this requirement.

2. Your account

You are responsible for keeping your sign-in credentials secure. Notify us promptly if you suspect unauthorized access. We may suspend or terminate accounts that violate these Terms or have been inactive for an extended period.

3. Products, pricing, and availability

We work to display accurate product images, descriptions, and prices, but errors can occur. Prices and availability may change without notice. If we discover a pricing error after you've placed an order, we will contact you to confirm or cancel — your card will not be charged a higher amount without your consent.

Colors and finishes may appear slightly different in person due to monitor variation.

4. Orders and payment

Placing an order is an offer to purchase. We accept the offer when we send a confirmation email. Until then, we may decline or cancel any order at our discretion (suspected fraud, payment failure, stock issue).

Payments are processed by our payment partners — Paystack (Africa), Stripe (global), and Flutterwave(Africa / global fallback). Charges appear on your statement under “Luciana” or the processor's descriptor.

Prices include applicable sales tax / VAT unless stated otherwise. Customs duties on international shipments are the recipient's responsibility unless we explicitly cover them.

5. Shipping

We ship across West Africa, the United Kingdom, and North America. Delivery estimates are guidelines, not guarantees. Risk of loss passes to you on delivery to the carrier.

6. AI virtual try-on

The site offers an AI-powered virtual try-on. Generated images are illustrative only — actual fit, drape, and color may differ. Try-on images are processed by Replicate or HuggingFace and cached briefly to improve quality, then deleted (typically within 30 days).

7. Intellectual property

All content on the site — including the Luciana name, logo, product photography, copy, and the “Own Your Light” tagline — is owned by Luciana or licensed to us, and is protected by copyright and trademark. You may not reproduce, modify, or distribute site content without written permission, except for personal, non-commercial browsing.

User-submitted content (reviews, photos) remains yours, but you grant us a non-exclusive, royalty-free license to display it on the site and in marketing.

8. Prohibited uses

You agree not to:

• Use the site for unlawful purposes.
• Resell products commercially without authorization.
• Scrape, mirror, or systematically copy site content.
• Attempt to disrupt, reverse-engineer, or breach the security of the site.
• Submit fraudulent or chargebacked orders.

9. Disclaimers

The site and products are provided “as is.” To the maximum extent permitted by law, we disclaim all implied warranties (merchantability, fitness for a particular purpose, non-infringement) other than those that cannot be excluded under applicable consumer protection law.

10. Limitation of liability

To the maximum extent permitted by law, Luciana's total liability for any claim arising from the site or a purchase is limited to the amount you paid for the product giving rise to the claim. We are not liable for indirect, incidental, or consequential damages.

11. Indemnity

You agree to indemnify and hold Luciana harmless from claims arising out of your breach of these Terms or your misuse of the site.

12. Governing law

These Terms are governed by the laws of the jurisdiction in which Luciana is registered. Disputes will be resolved by the courts of that jurisdiction. Where local consumer protection law overrides any provision of these Terms, that local law applies.

13. Changes

We may update these Terms from time to time. Material changes will be communicated via email and a banner on the site. Your continued use after a change constitutes acceptance.
